OFFICIAL RULES OF THE FAM JAM COMPETITION

You understand that you are providing your information to Administrator, and not to, Facebook, Twitter, Instagram or other social network or platform.

Eligibility: The Fam Jam Competition (“Competition”) is open only to natural persons who are legal residents of the continental United States who will be in the New York City, New York area on June 11, 2019, who are at least twenty-one (21) years of age at time of entry, and who have a valid Ticketmaster account at time of entry. Competition may only be entered from and in eligible jurisdictions; however, participants are responsible for their own travel to and from the Event (as defined below). Administrator and American Express Travel Related Services Company, Inc., (“Amex”) and their respective parent, subsidiary and affiliate companies, employees, agents and suppliers, as well as the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of each such individual, whether or not related, are not eligible to participate. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email account used to enter will be deemed to be the entrant (“Entrant”) and he/she must comply with these Official Rules. All potential Entrants are subject to verification before any prize will be awarded. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Competition. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Sponsor and Administrator: The Sponsor and Administrator of the Competition is Ticketmaster LLC (“Administrator”).

Timing:  Administrator's clock is the official time keeping device of the Competition. Submission Period and Judging Periods are collectively referred to herein as “Competition Period” and are described below.

Registration Period: 11:00 AM Pacific Time (“PT”) on May 13, 2019 and ends at 11:00 AM PT on May 24, 2019.

Judging Period: Participant presentations and judging will take place at the event on June 11, 2019.

How to Register: Via Internet, go to https://fanjam.ontouraccess.com/, log into your Ticketmaster account and complete the registration form. If you do not have a valid Ticketmaster account, you will be prompted to create a free account before you can register. Please do not register if you won’t be able to participate in the Fam Jam in New York, New York, scheduled to take place on June 11, 2019 from 9:00 AM Eastern Time (“ET”) to 7:00 PM ET (“Event”).

 

For all Registrations: Each person is eligible to submit up to one (1) registration entry during the Registration Period. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant's entries and that Entrant may be disqualified. Use of any automated technology or system to participate is prohibited and will result in disqualification and entry will be void. Any automated receipt (such as one confirming delivery of text message or e-mail) does not constitute proof of actual receipt by Administrator of an entry. Released Parties (as defined below) are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. All entries become the sole property of Administrator.

Prizes: One (1) Prize will be available to be awarded to each of the six (6) winning teams as described below. Each prize consisting of one (1) $100 Ticketmaster® Gift Cards (“Gift Card”) per winning team member. The Gift Card can be used for purchases online at www.ticketmaster.com, www.ticketmaster.ca, via Ticketmaster telephone lines and at participating authorized retail outlets and venue box offices. The Gift Card may not be redeemable at all Ticketmaster retail outlets or venue box offices. Please check your local outlet or venue about their Gift Card redemption policy. Gift Card may not be used for Fan-to-Fan resale or Platinum tickets. Other exclusions may apply. The Gift Card cannot be combined with any other Gift Cards, gift certificates or other coupons. Gift Cards may not be used in connection with any marketing, advertising or promotional activities without Ticketmaster’s prior written approval and may not be sold other than through authorized Ticketmaster channels. Ticketmaster reserves the right to cancel a Gift Card if it believes that the Gift Card was obtained through fraudulent or unauthorized means. If the Gift Card holder’s purchase exceeds the amount of that Gift Card’s balance, the Gift Card holder must pay the difference by another means. Unused Gift Card balances are not transferable.  Subject to Ticketmaster Gift Card Terms of Use found at http://www.ticketmaster.com/h/giftcards/terms.html. All ticket purchases are subject to the Purchase Policy found at http://www.ticketmaster.com/h/purchase.html.  Approximate Retail Value of each Prize is: One Hundred Dollars and No Cents ($100.00)

For all prizes: Lost or stolen prizes will not be replaced. Prize does not include any other item or expense not specifically described in these Official Rules, and any such additional expenses are the sole responsibility of Team members. Prizes may not be transferred or assigned. Only listed prizes will be awarded and no substitutions or cash equivalents or redemption will be made, except that Administrator reserves the right to award a prize of equal or greater financial value if any advertised prize (or any component thereof) becomes unavailable. Winners agree to accept the prize “as is”, and Entrants hereby acknowledge that Administrator neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Any valuation of any prizing stated above is based on available information provided to Administrator and the value of any prize awarded to a winner will be reported for tax purposes as required by law. Team members are responsible for reporting and paying any and all applicable taxes. Each winner must provide Administrator with a valid taxpayer identification number or social security number before any prize will be awarded. A Form 1099 will be issued to the finalists and winner for value of prize of $600 or more.

Selection of Participants and Potential Award Winners:  Administrator will invite up to one hundred (100) eligible Entrants who complete the registration form to participate in the Event (“Participants”). One or more of the other eligible Entrants may be selected as alternates at Administrator’s sole discretion to participate should an originally-selected Participant decline to participate and/or to be determined to be ineligible. Alternates are not guaranteed a spot at the Event until receiving confirmation that they have been moved from the alternate list to the selected participant list. An invitation will be sent to all selected Participants on or about May 29, 2019 to participate in the Event scheduled to take place from 9:00 AM ET to 7:00 PM ET on June 11, 2019. Potential Participants will have up to forty-eight (48) hours at accept the invitation.  In the event that a potential Participant is disqualified for any reason or fails to accept the invitation within forty-eight (48) hours, Administrator may select an alternate participant at their discretion by selecting the next eligible Entrant to have completed the registration form. Each selected Participant will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (“Affidavit”) (except where prohibited) within a time period specified by Administrator prior to the Event in order to participate. If a potential Participant fails to sign and return the Affidavit within the required time period, such potential Participant will be disqualified.  Administrator reserves the right to change the Event date. Administrator will not be responsible for any costs incurred by Entrant as a result of date change or any other changes in the Competition. Participants are responsible for their own travel to and from the Event.

At the Event, Participants will form into groups of 3-6 people (“Teams”) via random selection. Each Team will be presented with a business problem it must solve.  Each Team will come up with an idea (“Idea”). Each Team will be presented with the presentation guidelines (i.e., length, specific requirements) at the same time as the business problem is presented and will prepare one (1) presentation as follows:

Each Team will present their Idea to the panel of judges at the Event.  

 One (1) Team award will be given for each of the following Idea categories:

Most far out: Idea is so radical, and so far out –it could (almost) work.

So Wow, So Now: Idea that is so in the moment that it could be implemented tomorrow.

Innovative Creation: Idea that judges may have seen before, but with a forward-thinking twist.

Future Fun: Idea that is fun and fresh, but might not be ready to be implemented just yet,

Best In show: Idea presented with the best flare and style.

Fan favorite: All Participants will cast their ballot vote for their favorite Idea.

Presentation guidelines:

Each Team should include answers to each of the following in the Team Presentation:

  1. How clearly does Team articulate the consumer problem they are trying to solve?
  2. How well does the Idea match the problem?
  3. Is this Idea already in market? And is it unique?
  4. How creative was the Idea, both concept and presentation?
  5. How unique is the Idea or opportunity, can it be easily replicated by another?
  6. Does the Idea fit the brands, both American Express and Ticketmaster?

Presentations will be judged using a one (1) to five (5) point scale, with five (5) being the highest score a Team can achieve for each of the following criteria:

  • Creativity of presentation
  • Creativity of Idea
  • Long term impact
  • How well the Idea fits the brand partnership
  • Value
  • Simplicity
  • Replicability

The Idea(s) that receive the highest overall scores will receive one (1) of the awards described above.

In the event of a tie, judges will apply an “ease of use for consumer” criteria using the same point scale above to determine winning Team. Administrator’s decisions as to the administration and operation of the Competition and the selection of potential winners are final and binding in all matters related to the Competition. Administrator reserves the right to disqualify any Entrant, Participant or winner and may refuse to award any prize to a winner who has violated any rule, gained unfair advantage in participating in the Competition, or obtained winner status using fraudulent or illegal means.

All potential winners are subject to verification by Administrator.  Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Each potential winner will be notified in person at the Event.

Ownership of Idea: Each Participant understands and agrees that any Idea submitted by Participant during the Competition will be owned by the Administrator and Amex and, as such, Participant disclaims any ownership rights to the Idea. Participant will be required to transfer or otherwise assign the Idea to Administrator and Amex, which will have the sole right to use, sell, offer for sale, license, exploit, promote, reproduce, make available, publicly display, publicly perform, create derivative works of, and otherwise exercise all intellectual property and other rights in and to the Idea. Each Participant will be required to sign additional documentation required by Administrator and/or Amex to formalize, effect or perfect such transfer.

Publicity: Participants acknowledge and agree that Administrator may film, photograph and/or make other forms of recording of Participants while they are participating in the Competition (“Recording”). Participants agree to allow Administrator and Amex to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Participant’s name, likeness, persona, social media identity, appearance, picture, silhouette and/or any recording or other reproductions of Participant’s physical likeness, voice and/or sounds (collectively, the “Image”), in any manner whatsoever as long as any such alteration does not diminish the integrity of the Image such that it no longer is an accurate representation of Participant, and to combine the Image with other images, text, graphics, photographs and artwork in connection with advertising, publicity, promotion, marketing and merchandising of the Recording, the promotion of the Competition, and any product or service of Administrator and Amex, their affiliates and partners, by all means and in any media, worldwide, without further payment or consideration.

Privacy: Information submitted by Entrants will be collected by Administrator’s systems based in the United States and such collection will be subject to applicable United States laws.  Entrants may withdraw personal data upon request; however, entrant will be disqualified if personal data is withdrawn prior to the determination of the winner(s) and fulfillment of the prize(s). Information submitted by entrants is subject to Administrator’s privacy policy: https://www.ticketmaster.com/h/privacy.html. Entrant’s participation in this Competition constitutes consent for Administrator and Amex to use Entrant’s personal information solely for the purpose of administering the Competition and awarding the prizes, unless Entrant has opted to receive e-mail communications from Administrator and Amex. Errors and Unauthorized Activity: Released Parties are not responsible: (1) for any incorrect or inaccurate information, whether caused by Entrants, third parties, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (2) for technical and/or communications malfunctions, errors or failures of any kind; (3) for unauthorized human intervention in any part of the Competition; (4) for technical or human error which may occur in the administration of the Competition or the processing of entries; (5) for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use or misuse of any prize; or (6) if the Competition cannot take place or if any prize cannot be awarded due to acts of war, natural disasters, weather or acts of terrorism. Administrator reserves the right to cancel, suspend and/or modify the Competition, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Competition, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it suspects or finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Administrator and Amex reserve the right to seek damages from any such person to the fullest extent permitted by law. Administrator and Amex’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Release: By participating in the Competition, Entrant (a) releases Administrator, Amex, prize providers, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively, “Released Parties”), from any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Competition (including any travel or activity related thereto), including the unauthorized or illegal access to personally identifiable or sensitive information or acceptance, possession, use, misuse, or nonuse of the prize that may be awarded; and (b) acknowledges that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, without limitation, the prize quality or availability.

Disputes: As a condition of participating in the Competition, Entrant agrees that: (a) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this Competition or the prizes awarded, shall be resolved individually, without resort to any form of class action, exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred and in no event shall Entrant be entitled to receive attorneys’ fees or other legal costs. Competition Entities reserve the right to modify prize award procedures. The Competition and these Official Rules, and the validity, construction, performance, and enforcement thereof, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Winners List: To obtain a list of the names of winners of prizes with a value greater than $25, mail your request and a self-addressed, stamped envelope, up to sixty (60) days after the close of the Promotion, to The Fam Jam Competition TICKETMASTER WINNERS LIST, c/o Live Nation Entertainment, Inc., 7060 Hollywood Blvd., Hollywood, CA, 90028, Attention: Promotions Dept.
